Kenosha, Take 2

Part of insisting facts matter, which I do, is changing you opinion about something based on facts. I have changed my opinion regarding the Rittenhouse shootings in Kenosha. Legally, they both appear to be self-defense. I do think we have a case of Sheepdog Failure Syndrome, which I'll elaborate on below. Here's why I changed my opinion. (Here's an interesting take on this sheepdog mentality.)

I watched this video which argues that both of the shootings were self-defense. The too long; didn't watch version is that Rittenhouse brought his rifle and first-aid kit to Kenosha. His plan was to "de-escalate" protests and "run into danger" to rescue injured people. Good intentions, but we know what the road to Hell is paved with.

In the first shooting, one of the rioters, Joseph Rosenbaum, chases Rittenhouse and tries to take away his gun. (Rosenbaum was white and we have video of him being a belligerent asshole earlier that night.) Rosenbaum's actions make the shooting self-defense for Rittenhouse. After the shooting, Rittenhouse runs away. The mob, not knowing why Rittenhouse shot or if he plans to continue shooting, run after him.

Here I take issue with the video. The lawyer in the video thinks the mob is chasing Rittenhouse because "he killed one of ours." I think the mob was chasing him because they were concerned that a mass shooting was breaking out. In either interpretation, from Rittenhouse's point of view, he was legally in a self-defense situation, especially once he fell on his ass.

Now, here's where we get all the gross errors of judgement on Rittenhouse's part that made this disaster happen:

1) Carrying a long rifle in a situation like this is problematic. It's very tempting for angry people to try and take it away from you. In this case, it made Rittenhouse a very visible target as well.

2) Rittenhouse did not appear to have the skills or physical stamina to be out in this situation. He's perpetually getting into binds and getting outrun. He uses terms like "overwatch" which suggest he knows what's going on but he clearly hasn't done any of this stuff before.

3) Rittenhouse has affiliated himself with a "militia" trying to protect businesses. This "militia" has no command structure or organization and appears to be just a bunch of Tactical Teds roaming the streets. Once the shooting starts, it's every man for himself, leaving Young Rittenhouse alone.

So, Rittenhouse does not appear to be a murderer. He does, however, appear to have made a number of very bad decisions that got two people killed and nearly got himself killed. IANAL, so I don't know if those bad decisions are legally actionable or not.

The NRA and Russia

In yesterday's post, I promised to address the NRA's fascination with what should have been an obvious Russian spy, Mariia Butina. Here I go.

First, the NRA is ran by people who really like guns. (In other news, water is wet! Video at 10!) They really want everybody, world-wide, to run around packing maximal heat. As such, it doesn't take a lot to convince them that somebody from a foreign country might want to spread that right back home. It helps if that somebody has good, er, posture (yeah, posture - that's the ticket!) and is willing to sit raptly while men old enough to be her father tell her how Things Get Done.

Second, the NRA is ran by Americans. They don't understand that the world is not composed of Americans, and so they don't understand a lot of either why the US became so gun-happy nor how Things Get Done Over There. I'm sure a lot of NRA figures never even thought to ask why Butina, if she was advocating changing Russian law, wasn't getting harassed half to death by the Russian government. The only viable answer is of course that she was working for the government. Which meant that the whole Right to Bear Arms organization she was "running" was a scam.

Third, a sizable portion of the NRA membership and leadership see themselves as "sheepdogs." (More here - summary is sheepdogs are here defined as scary people with a capacity for violence who protect the sheep from the wolves.) Putin has positioned himself as a sheepdog protecting (white) Christians from (brown) Islamic terrorists. Working with Putin is not a deal-breaker to them, although if they realized the Russian gun movement was bogus, it might be.

In short, much like Trump, the Russians found some not-bright people and sent an appealing package to tell them what they wanted to hear.

Sheepdog Bites Sheepdog, Tape at 11

So I've expressed before my dislike of the "sheep, wolves and sheepdog" meme. Late yesterday comes news of a white dude who tackles a black dude because the black dude is carrying a gun. Black dude, it turns out, has a legal concealed carry permit.

Needless to say I Am Not Amused. I don't want to focus on the racial aspect (although clearly it was a factor) but rather the sheepdog aspect. Sheepdogs herd, whether or not whatever they're herding needs to be herded. That can be problematic, as in this case, where the appropriate response would have been to just call the cops.

Thus endeth the lesson.

Guns, Sheep, Wolves and Sheepdogs

A prevalent meme in conservative circles is that people can be categorized into three classes: wolves, or those that prey on others, sheep, or the prey, and sheepdogs. Sheepdogs are here defined as scary people with a capacity for violence who protect the sheep from the wolves. But, as the saying goes, “The sheep generally do not like the sheepdog. He looks a lot like the wolf. He has fangs and the capacity for violence.” Perhaps left unspoken is that many conservatives see themselves as sheepdogs.

In any event, the meme is not without merit. I do, however, have some concerns about this meme in practice. One of those concerns is that some people think they are sheepdogs when they are really toy poodles.

Take George Zimmerman. Per his statement, a 158-pound kid walked up to him, gave him some lip, then laid him out on his back with one punch. Zimmerman is just over 200 pounds. One would think that somebody with any training, if not common sense, when confronted by a person who was perceived as a threat, would have assumed a defensive posture. This sheepdog apparently wrote a check his body couldn’t cover.

I would hope that, if somebody is breaking into my house, the neighbors would call the police. I would hope that, would I need help, it would be offered, and I hope that I would see when others needed help and offer it. Yet I detect in some human sheepdogs the same sort of over-eagerness that leads border collies to try and herd geese. They are not just willing to help, they are looking to help whether I need it or not.

When the final rules on concealed carry are issued for Illinois, I will probably get a permit. Having gone 40+ years without carrying, I see no reason to start now, but I would like the option. (Call me a porcupine.) My concern is that some number of concealed-carry permit-holders think they’re sheepdogs but are really toy poodles looking to herd some geese.
